Nokia, a Finnish telecommunications company, has won a preliminary injunction against Vivo, a Chinese smartphone manufacturer, to prevent the latter from selling smartphones in Germany that include Nokia-patented technologies. This follows Nokia’s successful legal action against Oppo and OnePlus, both of whom have been prevented from selling their phones in Germany for the same reason. Nokia alleges that Vivo refused to pay the appropriate licensing fees for using its patented technologies, leading to the current situation.

 

Nokia’s Patent Crusade

Nokia claims that its patents cover a wide range of mobile and 5G technologies, and it has taken “every possible step” to negotiate a licensing agreement with Vivo before taking legal action. Nokia insists that it is illegal to distribute smartphones using its patented technologies without paying the appropriate licensing fees.

 

Vivo’s Response

In a statement on its website, Vivo has expressed its intention to appeal the decision, stating that Nokia has not licensed its patents fairly. However, Nokia has refuted this claim, saying that the Mannheim District Court has affirmed the company’s fairness. Despite this setback, Vivo has said that it will continue to seek a settlement with Nokia on “fair” terms while also preparing for a possible sales stoppage in Germany.

 

No Impact on Oppo and OnePlus

BBK Electronics, a Chinese conglomerate, owns Oppo, OnePlus, and Vivo. Vivo’s presence in Germany has been relatively limited, and a sales ban would only affect a small number of models. Oppo and OnePlus operate independently under the BBK umbrella and are not directly affected by Nokia’s legal action.
